Abstract

This article presents an empirical study aimed at analyzing how, from the parents’ perspective, the hearing of children and adolescents in family mediation could take place in Brazil in order to ensure the realization of their best interests. Data were collected through questionnaires and semi-structured interviews with mothers and fathers who experienced judicial disputes in the Family Courts of Fortaleza/CE. The data were processed using the Content Analysis method and examined through the lens of literature on childhood, youth, and family mediation. The findings indicated that protected hearing, conducted by specialized professionals, can facilitate parental reconfiguration and strengthen child and adolescent participation without overburdening them with responsibilities. Most parents (84%) supported this practice, emphasizing the importance of developing structured protocols and training qualified mediators. Although further research is needed to refine strategies that balance listening to and protecting children and adolescents in the context of mediation, it was concluded that the Brazilian legal system must ensure that they are heard with respect in custody and visitation proceedings, in accordance with the Child and Adolescent Statute and the Convention on the Rights of the Child.
