Abstract

This article examines the current legal relevance of the so-called Collor Plan I differential in rural credit transactions indexed to savings account rates, with emphasis on the controversy surrounding the readjustment criterion applicable to the outstanding balance of rural credit notes in March 1990. The study proceeds from the premise that the issue is not limited to a historical divergence between inflation indexes, but rather involves the normative structure of rural credit, the regulatory linkage between rural savings accounts and the transactions funded by them, the coherence of the contractual regime, and the economic and procedural consequences of undue charges. The article demonstrates that the statutory and regulatory framework governing rural credit, especially Law No. 4,829/1965, CMN Resolution No. 1,188/1986, and Central Bank Circular No. 1,130/1987, imposed a correlation between the funding source and the index used to update rural transactions. Accordingly, the application of the IPC index of 84.32% instead of the BTNF index of 41.28% represented a breach of the system’s normative symmetry and an artificial increase in the producer’s debt burden. The study also analyzes the consolidation of the Superior Court of Justice’s case law in favor of the BTNF and the submission of the matter to the Federal Supreme Court under General Repercussion Theme No. 1,290, highlighting the effects of the nationwide stay of pending lawsuits and the delay in a final merits ruling as additional factors undermining effective judicial protection. On the procedural level, the article addresses simple restitution of undue payment, the limitation period applicable to restitution claims, the complexity of liquidation proceedings, and the obstacles to enforcement of judgments, showing that the difficulty in recovering the amounts owed derives not only from the substantive controversy over the correct index, but also from fragmented enforcement, institutional resistance by debtors, and the slow pace of decision-making by the higher courts. It concludes that the Collor Plan I differential remains a continuing legal liability within rural credit, with financial consequences that extend to subsequent renegotiations, and that restoring contractual balance requires not only recognition of the legally applicable index, but also a procedural interpretation guided by the maximum effectiveness of judicial protection, so as to prevent institutional delay from emptying the producer’s substantive right in practice.
